Terms and conditions

Article 1: General

1. These terms and conditions shall apply to any agreement entered into between Bungee Super Fly and the customer.
2. By placing an order at Bungee Super Fly, customer agrees to the terms and conditions of Bungee Super Fly.
3. Unless otherwise agreed, the applicability of other general conditions excluded.
4. Bungee Super Fly has the right to change these terms and conditions and the content of its website at all times

Article 2: Definitions

In these general conditions, the following definitions shall apply:

1. Entrepreneur: the natural or legal person that offers products and/or services to customers;
2. Customer: the natural person who to Bungee Super Fly the ordering the supply of products or the provision of services.
3. Day: calendar day
4. These general conditions apply to all offers, orders and agreements with Bungee Super Fly. Accepting an offer and/or placing an order implies that the customer agrees to these terms and conditions.

Article 3: Offers and agreements 

1. All offers of Bungee Super Fly are valid while supplies last.
2. An agreement between Bungee Super Fly and the customer is concluded by the confirmation of the order by the customer. This confirmation shall be carried out by means of a confirmation email.

Article 4: prices and payments

1. All prices are in euros, excluding 21% VAT, including shipping within Netherlands.
2. Payment can be made by means of bank transfer, Ideal or credit card.

Article 5: Shipping

1. After receipt of your payment, your order will be sent within approximately 5 working days. If it may be different, the customer will be informed within 3 days.
2. The customer can have it delivered home or at a different address. The delivery address is the address in the confirmation email of Bungee Super Fly.

Article 6: Delivery 

1. Shipping within the Netherlands is free.
2. For shipment abroad the shipping charge to the country concerned will be charged to the customer. These rates you could reclaim by email, via info@bungeesuperfly.com
3. Bungee Super Fly is not liable for any loss and/or damage to the products during shipping sent, regardless of way of shipping.
4. Bungee Super Fly is not liable for any costs for declaration products entering a country.

Article 7: Cancelation

The customer is able to cancel the order free of charge within 24 hours by email. If an article is not in stock, the customer will be informed about this by e-mail. The customer has the right to cancel the entire order free of charge. If the payment is already received by Bungee Super Fly, it will be refunded within 14 days.

Article 8: Exchange and return

1. If a product does not meet the expectations of the customer, then the product can be notified within 7 days of receipt to return or replace the product. The customer is obliged to inform by email info@bungeesuperfly.com Bungee Super Fly which products they want to exchange or return.
2. The products must be logged on for return within 7 days after delivery and notification to be sent to Bungee Super Fly. It is advised to send evidence to save well.
3. The products must be unused and undamaged in the original packaging to be returned.
4. When there is a product defect or if we have made an incorrect item, we will always pay you back, shipping costs incurred. Do you have a wrong item ordered or would you come back to the purchase, than are the shipping costs of returning the items for your own account.
5. If the above conditions are satisfied, then the purchase amount (excluding shipping costs) within 14 days after receipt of the return on the account number will be refunded.

Article 9: warranty

1. Bungee Super Fly guarantees that all products meet the usual requirements and free from defects. This warranty is valid for the period of 7 days after date of delivery.
2. If a product is within the warranty period of 7 days anyway to be defective, then will exchange or repair the product Bungee Super Fly. If Exchange or repair is not possible, then the customer is notified, and the purchase amount will be refunded within 7 days.
3. The warranty does not apply if the defect is caused by improper use.
4. The warranty expires when the customer tries to repair the defect themselves without consultation and/or instruction has not succeeded.

Article 10: complaints and liability

1. For shipping the products are carefully controlled by Bungee Super Fly. If there are still complaints about an ordered product, the customer may communicate this within 7 days of receipt via email: info@bungeesuperfly.com. Bungee Super Fly will respond via email within 7 days on the complaint.
2. Bungee Super Fly will assess the complaint. If a complaint is justified, shall reimburse Bungee Super Fly up to the purchase price plus the shipping costs for returns. Used items are not refundable.
3. Bungee Super Fly is not liable for damage caused by improper use of the product.
4. Individual settings of displays, cannot be excluded.
5. Bungee Super Fly is not liable for any direct or indirect damage caused after delivery, from any cause whatsoever with the customer or to third parties.
6. Bungee Super Fly and all associated people and organizations accept no responsibility for any injury, accident or death caused by any of the products supplied. It is the responsibility of the user to take the necessary precautions and to minimize hazards.
7. It is the user’s responsibility to purchase third party insurance before teaching with our equipment. Bungee Super Fly recommends all users to have proper insurance.

Article 11: Privacy

1. Bungee Super Fly uses your personal information to the execution and settlement of your order.
2. With your permission we use your information to inform you about workshops and possible actions. If you no longer wish to receive this information, you can let us know by sending an e-mail to info@bungeesuperfly.com. Your personal data will not be provided to third parties and Bungee Super Fly will protect your data at all times and confidential.

Article 12: Copyright

Without prior written permission of Bungee Super Fly, we do not allow any product to reproduce, transmit or make available on a network.

Article 13: Applicable law and disputes

1. All legal relationships which Bungee Super Fly party, is also the only Dutch law applies, if it is an agreement with a customer that his/her residence abroad. The applicability of the Vienna Sales Convention is excluded. With exception if agreed differently in an agreement between two parties.
2. The parties will only do a job on the right, after they have made efforts to do its utmost to resolve a dispute in mutual consultations.
